Throwdown Warranty

Throwdown warrants to the original purchaser that its products are free from defects in materials and workmanship for the warranty period listed below that begins from the date of purchase unless otherwise stated. This warranty is valid so long as it remains in the possession of the original purchaser with proof of purchase required.

Items supplied to Throwdown by a third party supplier are covered by the manufacturer’s warranty, and any additional warranty information can be provided upon request or by visiting the manufacturer’s web site.

This limited warranty applies to Throwdown products designed specifically for commercial use only and is void when such products are used in a noncommercial environment or installed in a facility within a country outside of the country of original sale.

All warranties can be voided for products that were damaged due to misuse, abuse, alteration, negligence, maintenance, storage, handling, or transport. Throwdown requires that equipment is installed by a qualified and licensed contractor. Improper installation is cause for voiding of warranty. Damage to equipment that was not installed by a qualified and licensed contractor will be reviewed on a case by case basis. Failure to properly care for and maintain the product is cause for voiding of warranty.

Limited Lifetime Warranty

Throwdown will warranty this product from defects in materials and workmanship for the lifetime of the product as long as the product is used in a manner that is consistent with the intended purpose. This warranty extends to the original purchaser and is not transferable. This warranty ends when the product becomes unusable for reasons other than defects in material or workmanship.

Specific Period Warranty

Throwdown will warranty this product from defects in materials and workmanship for the period specified as long as the product is used in a manner that is consistent with the intended purpose. This warranty extends to the original purchaser and is not transferable.

Specific Exclusions

Softgoods and upholstery are warrantied to be free from defects in materials and workmanship only. This warranty does not extend to cover damage due to the items coming in contact with sharp or abrasive objects.

Medicine balls, slam balls, and stability balls are warrantied to be free from defects in materials and workmanship only. This warranty does not extend to cover damage due to items coming into contact with sharp or abrasive objects, use outside defined parameters or damage due to crushing under excessive weight.

Heavy bags and hanging hardware for the heavy bags are warrantied to be free from defects in materials and workmanship only. This warranty does not extend to cover damage due to the items coming in contact with sharp or abrasive objects. The bags are not warrantied from damage that occurs while the bags are not hanging from the supplied hardware. Using the bags on the ground will void the warranty. Hanging from the bag, adding additional weight, or adding an accessory to the bag that is not expressly approved by Throwdown will void the warranty.

Printing is warrantied to be free from defects in materials and workmanship only. Damage or discoloration due to wear, abrasion, or incompatible cleaners is not covered by this warranty.

Powder coat, paint, and plating finishes are warrantied to be free from defects in materials and workmanship only. This warranty does not extend to equipment that has been installed or used outside or in a wet environment. Some surfaces of the equipment are considered wear surfaces and are subject to scuffing, scratching, and discoloration. Damage to the finish on wear surfaces is not covered under this warranty.

Remedy

Damaged product that is covered under this warranty can, at the discretion of Throwdown, be repaired or replaced. If an identical replacement is not available Throwdown may provide a comparable replacement. Cost of shipping, installation, and assembly is the sole responsibility of the customer unless otherwise stated. Warranty claim must be accompanied with the original invoice or receipt as well as proof of defect. THESE SHALL BE THE SOLE AND EXCLUSIVE REMEDIES OF THE BUYER FOR ANY BREACH OF WARRANTY.

The warranties provided herein are the exclusive warranties given by Throwdown and supersede any prior, contrary or additional representations, whether oral or written. ANY IMPLIED WARRANTIES, INCLUDING THE WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE THAT APPLY TO ANY PARTS DESCRIBED ABOVE ARE LIMITED IN DURATION TO THE PERIODS OF EXPRESS WARRANTIES GIVEN ABOVE FOR THOSE SAME PARTS. THROWDOWN HEREBY DISCLAIMS AND EXCLUDES THOSE WARRANTIES THEREAFTER. Some jurisdictions do not allow limitation on how long an implied warranty lasts, so the above limitation may not apply to you. THROWDOWN ALSO HEREBY DISCLAIMS AND EXCLUDES ALL OTHER OBLIGATIONS OR LIABILITIES, EXPRESS OR IMPLIED, ARISING BY LAW OR OTHERWISE, WITH RESPECT TO ANY NONCONFORMANCE OR DEFECT IN ANY PRODUCT, INCLUDING BUT NOT LIMITED TO: (A) ANY OBLIGATION, LIABILITY, RIGHT, CLAIM OR REMEDY IN TORT, WHETHER OR NOT ARISING FROM THE NEGLIGENCE OF THROWDOWN OR ITS SUPPLIERS (WHETHER ACTIVE, PASSIVE OR IMPUTED); AND (B) ANY OBLIGATION, LIABILITY, RIGHT, CLAIM OR REMEDY FOR LOSS OF OR DAMAGE TO ANY EQUIPMENT. This disclaimer and release shall apply even if the express warranty set forth above fails of its essential purpose.
